4. Product Categories and Access

4.1 Public Products

Accessories, BMH wellness products (non-cannabis), and café items are available to all registered users 18+.

4.2 Lifestyle Cannabis Products

Cannabis flower, pre-rolls, and vapes are available to registered users for personal use in accordance with South African law.

4.3 Medical Cannabis Products (Section 21)

Access to medical-grade cannabis products requires:

Valid Section 21 Authorization Letter from a licensed healthcare provider
Current medical cannabis prescription
Verification and approval by our medical team

5. Legal Compliance

You agree to use our products only in compliance with:

The Medicines and Related Substances Act (Act 101 of 1965)
Cannabis for Private Purposes Act
Section 21 of the Medicines Act (for medical cannabis)
All applicable South African laws and regulations

6. Medical Cannabis Requirements

Section 21 Authorization:

Valid for 180 days from issue date
Must be from a licensed South African healthcare provider
Subject to verification and approval
Prescription required after authorization approval
Products can only be purchased with a valid, current prescription

7. Orders and Payments

When placing an order, you agree that:

All prices are in South African Rand (ZAR) and include 15% VAT
Prices are subject to change without notice
We reserve the right to refuse or cancel orders
Payment must be received before products are shipped
You are responsible for providing accurate delivery information

8. Delivery and Shipping

For medical cannabis products:

Delivery requires ID verification
Prescription must be verified before shipping
Products cannot be delivered to minors
Delivery to physical address only (no PO boxes)

9. Returns and Refunds

Due to the nature of our products:

Medical cannabis products are non-returnable once delivered
Lifestyle cannabis products are non-returnable for safety reasons
Accessories and CBD products may be returned within 7 days if unopened
Refunds will be processed to the original payment method

10. Prohibited Uses

You may not use our services to:

Violate any laws or regulations
Purchase products for resale without authorization
Share your Section 21 authorization or prescription
Purchase medical cannabis products for another person
Use products in a manner inconsistent with medical advice
Provide false information or documentation

12. Disclaimer of Warranties

Our services are provided "as is" without warranties of any kind. We do not guarantee:

Uninterrupted or error-free service
Specific medical outcomes from product use
Compatibility with all devices or browsers

13. Limitation of Liability

Basotho Medical Herbs shall not be liable for:

Indirect, incidental, or consequential damages
Loss of profits, data, or goodwill
Adverse reactions to products when used as directed
Delays in delivery due to circumstances beyond our control

Misuse Section 21 authorization or prescriptions

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in South African courts.
